These General Terms and Conditions and Image Service Fees apply to all persons who utilise the services or material of the Bauhaus-Archiv / Museum für Gestaltung.
1. Fees are charged per file for the provision of digitised material. These fees depend on the type of institution and the intended use. A fee of €20 is charged for the private use of image files. All forms of public presentation are excluded. For non-profit and scholarly institutions, we charge a fee of €50 per image file. For commercial publishers and magazines as well as film and television (for documentaries and video reports), a fee of €100 per image file is charged. In addition, copyright fees may apply (see 5).
2. The image may only be used for the purpose stated in the order. In principle, only a non-exclusive right of use is granted for the purpose of one-time use. The digital copies must be deleted after the agreed use.
3. The image may not be reproduced, copied, duplicated or archived or used by way of other publications or third parties without prior written authorisation. Fees will be charged if this principle is violated.
4. Delivered images may not be cropped or altered without special authorisation. This also applies to reproduction on a modified support, such as textiles or glass. Watermarks on films may not be altered or removed.
5. If the reproduced works or digitised photographs are protected by copyright, these copyrights must be clarified by the ordering parties themselves before each publication and the costs incurred must be borne by the ordering parties themselves. Many artists and photographers whose works are in the Bauhaus-Archiv are represented by the collecting society VG Bild-Kunst (www.bildkunst.de). The Bauhaus-Archiv / Museum für Gestaltung is not liable for any third-party claims arising from the publication of the images.
6. All invoices must be paid in euros; other currencies will have bank charges added.
Photo credits and supporting documents
The following must be clearly indicated as the image source, irrespective of the copyright information: “Bauhaus-Archiv Berlin” and the photo credit. This information must be provided in such a way that there is no doubt about which photo credit and indication of origin apply to the image. In the case of newspapers and magazines, exhibition catalogues, online use and advertising, the photo credit must be provided directly alongside the image. The undersigned expressly recognises this obligation.
The Bauhaus-Archiv / Museum für Gestaltung will be sent a sample copy for its library without having to request one and free of charge.
